GENERAL INFORMATION

This section governs the general Terms and Conditions applicable to the User's access to and use of the Web Site: jobsync.netlify.app and app-jobsync.netlify.app (hereinafter "JobSync", or "the Web Site" without distinction), as well as any information, content, images, video, audio or other material communicated or present on the Web Site.

"Website" shall mean: the external appearance of the screen interfaces, both in static and dynamic form, i.e. the navigation tree; and all the elements integrated both in the screen interfaces and in the navigation tree and all those online services or memories that may be offered to users, as the case may be.

This Web Site is operated by Testigos de Vue S.A.C. (hereinafter "the Company" or "Testigos de Vue" interchangeably). Throughout the site, the terms "we", "us", "us" and "our" refer to Testigos de Vue. Testigos de Vue offers this website, including all information, tools and services available from the site, and you conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our Web Site, you are participating in our "Service" and agree to the following terms and conditions ("Terms of Service", "Terms"), including all additional terms and conditions and policies referenced herein and/or available through hyperlinks. These Terms of Service apply to all users of the Site, including without limitation users who are browsers, suppliers, customers, merchants, and/or content contributors.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you are agreeing to the Terms of Service. If you do not agree to all of the terms and conditions of this agreement, then you should not access the website or use any of the services.

Any new features or tools that are added to the current store will also be subject to the Terms of Service. We reserve the right to update, change or replace any part of the Terms of Service by posting updates and/or changes on our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - ABOUT JOBSYNC

JOBSYNC is a digital platform that supports companies in their recruitment and selection processes. JOBSYNC uses a series of tools and games to measure different aspects of candidates applying for a job in an organization, such as cognitive, emotional and personality traits.

The Company shall be the controller with respect to any personal information provided through the Website. The Controller is the legal entity that determines the purposes and means of the use (processing) of your personal data. If you wish to contact us, you can write to support@jobsync.com

We (may) use certain information "sub-processors", but these sub-processors may only use personal data strictly necessary for these sub-processors to complete their specific task or service. We only provide your personal data, subject to data processing agreements, which state that the sub-processors must maintain the confidentiality of your personal data, that the data may not be used for their own purposes and that all information will be used in accordance with applicable privacy legislation, including strict provisions in light of data security.

We reserve the right to transfer your personal data to a country outside the Economic Area of residence or international organization. If so, we will ensure that appropriate, adequate and necessary transfer mechanisms and safeguards are in place. You are entitled to receive a copy of any documentation showing the appropriate safeguards that have been put in place when making a request through support@jobsync.com.

Users may not use our products for any illegal or unauthorized purpose. Nor may they, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Users must not transmit worms, viruses or any code of a destructive nature.

Failure to comply with or breach of any of these Terms will result in immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

We understand that your content may be transferred unencrypted and involve: (a) transmissions over various networks; and (b) changes to conform or adapt to technical requirements of connecting networks or devices.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission from us.

The purpose of the collection and automated treatment of personal data is to maintain a fluid relationship between the user and JOBSYNC, favoring the management, administration, provision, expansion and improvement of the services to which the user decides to subscribe, as well as the use of such services by the users, the design of new offers related to such services, the sending of updates of the services, the sending, by traditional and electronic means, of technical, operative and commercial information about products and services offered by/at JOBSYNC.

The service automatically collects certain general information such as, for example, the number and frequency of visitors, behavior and scores obtained in the tools. This information is used, among other things, for statistical purposes.

JOBSYNC may use this data, which will be used anonymously, in aggregate form, confidentially and only for the research purposes of JOBSYNC or any entity to whom we deem it appropriate to provide this information. In addition, the results and scores obtained from the tools and games may be merged with data collected by other entities.

You expressly agree that use of, or the ability to use, the service is at your sole risk. The service and all products and services provided through the service are (except as expressly stated by us) provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

JOBSYNC reserves the right to offer users of the Website services and/or products of its own or of third parties, specifically, employment suggestions from other companies. The user accepts to receive these suggestions through the Web Site or through the email indicated in the personal data.

APPLYING FOR A JOB FROM JOBSYNC

For participating in processes on our web service, we will ask you to provide us with your personal data for:

  1. Facilitate the complete process procedure.
  2. Create statements, notes and planning related to the process.
  3. Maintain communications via mail or telephone with you about the application, if applicable. We process your personal data based on our legitimate interests for recruitment purposes. We are obliged to inform you that the retention of personal data in your job application may provide you with a disadvantage compared to other applicants for the same position.

In processing your personal data, we have balanced our legitimate interests against your fundamental rights and freedoms. Where necessary, we have taken appropriate measures to limit the implications and avoid unwarranted harm to you. For example, (i) we will only use your personal data for the specific purposes mentioned and (ii) we will only request/use personal data that we absolutely need for the application process.

JOBSYNC reserves the right to analyze candidate data according to our legitimate interest. Depending on the process, candidates may be contacted by companies interested in their profile.

JOBSYNC is in no way involved in the recruitment and selection processes administered on its platform. Thus, JOBSYNC has no control over the conduct of JOBSYNC and APPLICANTS and is not a party to any agreements entered into between JOBSYNC and APPLICANTS and, to the fullest extent permitted by law, assumes no liability in this regard.

JOBSYNC assessment results are valid for 12 months. During this period of time, candidates do not have the right to retake the assessments. During this period of time (12 months), these results will be validated in the event that candidates apply for another position and/or another company requests these same assessments as part of their selection process.

DELETION OF INFORMATION

The candidate has the right to delete his/her JOBSYNC account and associated data and results. However, the candidate cannot (i) apply for a selection process through JOBSYNC, (ii) create a new session, (iii) retake the assessments, until a period of 12 months has elapsed.

You may request deletion of your personal information by emailing us at support@jobsync.com with the information necessary for us to process your request. Any request for deletion of information will be subject to our Retention Policy described below. A note about our games: because some of our games are designed to assess instinctive behavior, which may be biased if the games are played more than once, once a candidate begins or completes the games, the Game Data and Trait Profile cannot be restored, modified, deleted or voided for a period of 12 months after completing the games.

OUR RETENTION POLICY

We retain Personal Information from you with your consent, or when we have an ongoing legitimate business need (for example, to provide you with a service or other information you have requested or to comply with applicable legal requirements). Where we do not have an ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in back-up files), we will securely store your Personal Information and isolate it from any further processing until such time as it is possible to delete it.

PROTECTION OF YOUR PERSONAL DATA

We have taken appropriate technical and organizational security measures to protect your personal data against loss, misuse, alteration and/or destruction. While we take reasonable care in providing secure transmission of information between your computer and our systems, we cannot guarantee the security of any information transmitted to us over the Internet.

Access to relevant personal data is only granted to those authorized organizations that require access to this data for their processes.

You are the sole owner of all information and data that you enter, submit, input and/or provide in your use of the Website, including, without limitation, your Profile Information, Private Information, and data collected from tools and games.

You hereby grant JOBSYNC and our affiliates the following non-exclusive license: A worldwide, transferable, perpetual, royalty-free, perpetual, royalty-free, sublicensable right to make, use, copy, reproduce, modify, distribute, publish, display, process, prepare derivative works of, and otherwise use your data for any purpose, without any further consent, notice and/or compensation to you or others, subject to applicable law and our Privacy Policy.

INTELLECTUAL PROPERTY RIGHTS

Content" shall mean all information, messages, graphics, drawings, designs, logos, names, trademarks, sound and/or image files, photographs, recordings, software and, in general, any kind of material accessible through JOBSYNC (hereinafter referred to as the "content").

The user agrees to:

  • Use the contents in a diligent, correct and lawful manner.
  • Not to reproduce, copy, distribute, transform or modify, make available, rent or communicate to the public the contents unless expressly authorized by the holder of the corresponding rights.
  • Not to suppress, evade or manipulate the copyright and other data identifying the rights of JOBSYNC or its owners incorporated to the contents, as well as the technical protection devices, digital identifiers or any other information mechanisms that could contain the contents or the management of rights.
  • Not to use the contents and, in particular, the information of any other kind obtained through JOBSYNC or the services, to issue publicity of any kind under any format, in Chile or abroad.

JOBSYNC owns all right, title and interest in and to "the Site" and all tools and games used. Any use of materials or descriptions, any derivative use of the Site or its materials, and any use of data mining, robots or similar data gathering and extraction tools is strictly prohibited. In no event may you frame any part of the Site or any materials contained therein.
